If the evidence generated by their systems is challenged in court, their value proposition collapses. To mitigate these risks of challenge, legaltech companies must ensure that every document that passes through their systems is traceable from start to finish.  <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Take a contract management platform (CLM): it manages the contract, enables collaboration, annotation, and negotiation, while ensuring full traceability of the various stages. Once the contract is approved, it is sent for signature in another tool. The problem is that there isn\u2019t always a verifiable link between the two systems to unequivocally demonstrate that the document sent for signature is indeed the version approved in the contract management platform. However, in a legal dispute, this issue can become a weakness that the opposing party will exploit to have the case dismissed.   <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Does AI exacerbate or fix these flaws?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">While AI enables legaltech companies to rapidly develop new product features, it also gives rise to a new kind of competition. Vibecoding, in fact, exacerbates the trend toward \u201cin-house\u201d development, which is often preferred over off-the-shelf solutions for cost reasons. As a result, we are seeing the emergence of electronic signature and contract management tools developed in-house by end users. This race for vibecoded features only exacerbates the problem of traceability and the creation of evidence chains that are complete, authenticated, usable, and admissible in court.   <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How can we strengthen the audit trails for digital documents?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">That is the role of the trusted third party. In the EU, certain providers of digital trust services\u2014such as time-stamping, seals, and signatures\u2014hold an eIDAS qualification. This ensures the highest level of security for the identification and integrity of exchanged documents, which means that the burden of proof shifts to the party contesting them.  <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Obtaining this eIDAS certification is a lengthy and costly process\u2014and that is precisely what makes it valuable. To strengthen the evidentiary value of a workflow or document, it may therefore be advisable for a legaltech company to work with these service providers. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why should a legaltech company integrate eIDAS-qualified building blocks into its workflows?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">First of all, this allows for the addition of a layer of digital trust without having to rebuild everything from scratch. A legaltech company can retain its interface, user journey, and business experience while integrating qualified evidence modules in the background via APIs. This provides automatic end-to-end traceability, resulting in an admissible body of evidence.  <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It's flexible: you can enable it as needed, depending on the level of risk associated with the document or transaction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And, in a market where legal tech offerings tend to be similar, this is a key differentiator.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How does this play out at Evidency?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Evidency operates as an eIDAS-qualified Trust Service Provider accredited by ANSSI.
